Landlord Gas Safety Certificates (CP12)

A Landlords Gas safety record also referred to as a landlord certificate is a record which is required by law to be held for all rental accommodation in the UK where there are gas appliances present.

The law requires all gas appliances in a rented property to be checked annually, with a gas safety record being completed & a copy of the certificate provided to tenants.

Failure to produce valid landlord gas safety certificates can result in prosecution, and can also invalidate the properties insurance, which in turn means as a landlord you may be liable for potentially expensive civil claims.

The landlord is responsible for this aspect of their tenants’ safety, and if non-compliance were to lead to a death from carbon monoxide poisoning or other catastrophes, the landlord could be charged with manslaughter.

NOTE: A gas safety inspection is similar to a car “MOT”, no repairs or maintenance work is carried out, it is a safety inspection ONLY. A safety inspection is not a substitute for a service. Appliances should be serviced annually. If a service is carried out at the same time as a CP12 an extra charge of £20.00 per appliance serviced applies.

Safety inspections tests include:

  • Full system soundness test to confirm no gas leaks in the property
  • Appliances checked for gas soundness
  • Standing and working pressure checks
  • Burner pressure/gas rate checked against manufacturer’s data plate/manual
  • Ventilation check
  • Flue flow test to ensure removal of products of combustion
  • Checking satisfactory operation of all flame failure devices
  • Checks for any installation defects that don’t comply with current regulations
  • An investigation into any evidence of unsafe operation and report to the responsible person
  • Certificate (CP12) issued to the tenant
Landlord’s responsibilities include:
  • Maintenance: Pipework, appliances, and flues must be maintained in a safe condition. Gas appliances should be serviced in accordance with the manufacturer’s instructions. If these are not available it is recommended that they are serviced annually.
  • Gas safety checks: A 12 monthly gas safety check must be carried out on every gas appliance/flue. A gas safety check will make sure gas fittings and appliances are safe to use.
  • Record: A record of the annual gas safety check must be provided to your tenant within 28 days of the check being completed or to new tenants before they move in. Landlords must keep copies of the gas safety record for two years. View “Gas-Safe” advice leaflet (opens in a new browser window).
